Real property purchase procedure: Samos island
Once an agreement is reached at the real-estate agency concerning the price and the way of payment, in order to secure the interests of both contracting parties and as long as the final agreement is signed, a meeting with the Notary and the two attorneys representing the two contracting parties, the seller and the buyer, is scheduled.
The real property on sale should be listed on E9 taxation form, which is an exclusive responsibility of the seller. Additionally, a topographical survey, recently authenticated by the competent Urban Planning Service, displaying the total area of the property should be included. The examination of the title deeds by the attorneys of the contracting parties is following.
The required forms, which are to be submitted to the competent Revenue Office, are available at the Notary’s. In order for a real property to be transferred, both contracting parties should have their tax documentation issued by the competent Revenue Office, to which the relevant documents will be submitted to the competent auditor.
The buyer should then address the competent Revenue Office, where the real value of the property is appraised and the transfer tax is paid. As soon as the competent Revenue Office authenticates the documents, we address the Notary, who makes up the purchase contract, which in turn is signed by the two parties.
Moreover, the Notary registers the new owner of the property at the Land Registry Service, after the buyer makes the final payment.

*The fees as well as VAT are paid by the two contracting parties upon the day of the first notary act, which is not upon the final act, unless an arrangement is made otherwise.

Concerning alien buyers, a withdrawal of the contracting ban, which is ruled by the L.1892/90 article 26, should have been issued by the Prefecture of Samos, in order for any notary act to be valid.
